In a groundbreaking move, New York has become the first state in the nation to impose a moratorium on new AI datacenters. Governor Kathy Hochul signed an executive order on Tuesday, halting the construction of large-scale facilities that power artificial intelligence technologies. This decision comes amid growing concerns about the environmental and economic impacts of these energy-intensive operations.

The moratorium, set to last up to one year, targets hyperscale datacenters with an electrical capacity exceeding 50 megawatts. During this period, state regulators will develop comprehensive standards addressing energy demand, water usage, and environmental impacts. Hochul emphasized the need to protect New Yorkers from rising utility bills and resource depletion caused by the rapid expansion of AI infrastructure.

Addressing the Growing Concerns

The decision to pause new datacenter construction is a response to the increasing public outcry over the facilities’ effects on energy prices and local environments. A recent Heatmap poll revealed that nearly three-quarters of Americans oppose the construction of datacenters near their homes. The moratorium aims to provide a much-needed respite while the state establishes a robust framework to mitigate these concerns.

New York is not alone in its efforts to regulate datacenter development. Several states have considered similar moratoria, and Maine briefly approved one before it was vetoed by the governor. Additionally, a small city in southern California and Seattle have recently enacted their own moratoria, highlighting a nationwide trend towards cautious regulation of AI infrastructure.

Balancing Innovation and Responsibility

Governor Hochul stressed that while New York remains committed to leading in innovation, it is crucial to ensure that datacenters are built responsibly. The moratorium will allow the state to explore requirements for datacenters to either generate their own energy or pay higher rates, thereby alleviating the burden on residents’ utility bills. Hochul also proposed ending tax exemptions for large datacenters, aiming to ensure that these facilities contribute fairly to the state’s economy.

The state legislature had already approved a one-year moratorium bill, which included provisions for an environmental impact report and new labor, energy efficiency, and transparency standards. Hochul’s executive order aligns with these legislative efforts, setting a higher threshold for datacenter size at 50 megawatts, compared to the 20 megawatts approved by the legislature.

Community Benefits and Future Plans

Hochul outlined a broader vision for AI regulation, directing her administration to create a framework for communities hosting datacenters. This framework aims to ensure that residents benefit significantly from these facilities. The governor emphasized that datacenters should only be built in places that want them respecting local zoning laws and community preferences.

During the moratorium, the state will prepare a Generic Environmental Impact Statement (GEIS) to establish statewide standards for future AI datacenter development. This study will examine issues such as electricity demand, impacts on the power grid, water use, air quality, and other potential environmental impacts. Once completed, new AI datacenters will be required to comply with these standards before receiving approval.

The moratorium also directs the state’s Department of Public Service to develop a fund that datacenter operators may be required to pay into. This fund could include an insurance pool to protect ratepayers from stranded grid costs tied to projects that are delayed, scaled back, or never materialize. Additionally, the state will provide local governments with a playbook to help communities negotiate with technology companies seeking to build nearby.
